Short‑Term Rental Agreement
This Short‑Term Rental Agreement (the “Agreement”) is entered into and made effective as of the signing date by and between the PropertyManager/Operator (“Manager”) of Beachside VR, LLC and the Guest (collectively, the “Parties”). Guest’s occupancy is granted solely as a revocable license under §§83.42(3) and509.141, Florida Statutes; no landlord‑tenant relationship is created. Terms not specified in this Agreement are governed by the House Rules or Reservation Policies provided separately by the Manager.
Accommodation Terms
- Respectful Behavior: The Guest shall follow all local laws and regulations and act with consideration for neighboring property owners. Quiet hours are 10PM-7AM. Violations may result in immediate termination of this Agreement without refund.
- Use of Property: The Guest shall not use the property for any illegal activity or unauthorized commercial purpose. Sub‑leasing or exceeding the stated maximum occupancy without prior written approval from the Manager is prohibited.
- Occupancy Dates: Guest occupancy is limited to the dates shown on the reservation confirmation. Check‑in is 4PM; checkout is 10AM. Unapproved early arrival or late departure may incur additional charges.
- ID Verification: The primary renter must be 18 years or older and provide a valid government photo ID that matches the name on the payment method. The Manager may cancel or refuse any reservation lacking verified ID, where the ID does not match the payment method, or where the guest is on a blacklist maintained by BeachsideVR or its partners.
- Immediate Removal for Rule Breach: In accordance with §509.141, Fla.Stat., the Manager may demand immediate departure-and treat refusal as trespass-for any material violation of this Agreement, including unauthorized events, pets, or disruptive noise.
- Right of Entry: The Manager or representative may enter the property with 24 hours’ notice (or without notice in an emergency) for inspection, maintenance, or safety.
- Noise‑Monitoring Disclosure: Certain properties are equipped with exterior‑facing security cameras and interior decibel‑only noise sensors that monitor sound levels but do not record conversations or video indoors; by booking, the Guest consents to their use.
- Parking: Parking is limited to designated areas. Extra vehicles require prior approval.
- Events: Events or gatherings exceeding the maximum guest count require the Manager’s prior written consent. Unauthorized events may terminate this Agreement without refund.
Pest Liability Release
The Guest acknowledges that the Manager has inspected the Premises and is aware of no rodents, bedbugs, or other infestations. The Guest shall ensure that all personal property brought onto the Premises are pest free. The Guest shall maintain reasonably proper housekeeping and cleanliness to avoid pest infestation. The Guest shall notify the Manager immediately of any pest infestation and cooperate with all necessary pest control efforts. If pest remediation is needed, the Guest shall comply with proper preparation for treatment and prevention. The Manager will not be held liable for any damages or loss of personal property as a result of a pest infestation or remediation.
Other Amenities
Amenities such as grills, bikes, beach gear, kayaks, swimming pools, and hot tubs are provided at the Guest’s sole risk. The Guest acknowledges inherent hazards of water‑related activities, agrees that children will be supervised at all times around pools or open water, and that approved flotation devices will be worn when kayaking or paddle‑boarding. The Guest assumes all liability for injury, damage, or loss arising from use or misuse of any amenity.
Personal Property Disclaimer
The Manager is not responsible for loss of money, jewelry, electronics, or other valuables left on the premises. Items found after checkout will be held for 30days; unclaimed items may be donated or discarded without further notice.
Force Majeure
The Manager is not liable for delays or failures caused by events beyond reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, government actions, labor disputes, or telecommunications outages.
If a state, county, or municipal authority issues a mandatory evacuation order covering the property, the Manager will refund unused nights for which the Guest is unable to occupy the premises. Voluntary cancellations outside a mandatory order remain subject to the standard Cancellation Policy.
Damage Waiver or Refundable Security Deposit
Applicability. For all bookings other than Airbnb, Guest must select one of the options below. For Airbnb bookings, a Damage Waiver may be offered as an optional add-on; if not purchased, Guest remains responsible for damage under this Agreement and any platform rules.
A. Damage Waiver (non-refundable, per-night)
For eligible accidental damage, Guest may purchase a Damage Waiver at the property-specific nightly rate shown in the guest portal ($15–$30 per night, capped at $130 per stay) which waives Guest’s financial responsibility up to $500 per stay. To qualify, damage must be (i) unintentional/accidental, (ii) reported to Company within 24 hours of occurrence and before checkout, and (iii) not otherwise excluded. Exclusions include: intentional acts, negligence/recklessness; unauthorized pets; smoking/vaping; parties/events; excessive cleaning; stained/damaged linens/soft goods; lost keys/fobs/garage remotes; rule/HOA/municipal fines; tampering/relocating furniture or equipment; and any unreported damage. Company has sole discretion to determine qualification and amount. This Waiver is not insurance and is not a limit of liability.

B. Refundable Security Deposit (card pre-authorization)
If Guest declines the Waiver (or where applicable), Company will place a pre-authorization hold on the card on file in the property-specific amount of $600–$800 [3 days before arrival to cover incidentals, fines, and damage. The hold is not a charge. Any unused portion is released after inspection, typically within 7–10 business days (bank timing may vary).
Guest Responsibility; Authorization to Charge.
Guest is responsible for all costs to repair or replace damage, remedy excessive cleaning, replace missing items, pay unauthorized late checkout fees, third-party call-outs (e.g., locksmith, HOA/security, emergency services), and any fines/fees attributable to the stay. Guest irrevocably authorizes Company (and its payment processor) to (i) capture part or all of the Security Deposit hold and/or (ii) process a delayed charge to the card on file for amounts due, including amounts exceeding the Waiver limit or Security Deposit. Company will provide an itemized statement describing the basis for charges and supporting evidence (e.g., time-stamped photos/video, staff/inspector logs, vendor invoices/estimates, sensor reports). The Waiver/Security Deposit is not a limit of liability.
Inspection & Notice.
Company documents conditions before and after each stay. Company will notify Guest of any charges within [7] days after checkout. Guest may provide additional information within [3] days of notice; lack of response will not delay processing.
Airbnb Bookings Addendum.
For reservations made via Airbnb, damage claims and payments are handled through the Airbnb platform (e.g., Resolution Center or as otherwise permitted by Airbnb). Where offered, the optional Damage Waiver applies on the terms above ($15–$30 per night, capped at $130; up to $500 coverage). Guest remains responsible for all damage, fees, and costs as stated herein.
Breach & Remedies.
Failure to pay amounts due under this section is a material breach. Company may charge the card on file, capture the Security Deposit, pursue additional collection, and/or legal remedies. This section survives checkout.
Indemnification Clause
The Guest shall indemnify, defend, and hold harmless the Manager, Beachside VR, LLC, and their affiliates, officers, agents, and employees from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from the Guest’s breach of this Agreement or use of the property. This obligation survives termination of the Agreement.
Liability Waiver & General Release
The Guest, for themselves and any invitees, in consideration of the right to occupy and use the property, amenities, and services provided by Beachside VR, LLC, irrevocably releases, discharges, satisfies, and forever holds harmless Beachside VR, LLC, the property owner, and each of their officers, employees, agents, successors, and assigns from any and all claims, demands, actions, causes of action, liabilities, damages, injuries, losses, costs, or expenses of every kind, whether now known or unknown, fixed or contingent, and whether arising in contract, tort, statute, or otherwise, that in any way relate to or arise out of the Guest’s stay or use of the property, its surrounding areas, and any equipment or amenities provided, including without limitation grills, bicycles, kayaks, pools, beach gear, and other recreational items. This release extends to all claims that may hereafter accrue, and the Guest covenants not to sue or otherwise pursue any legal proceeding against any released party concerning any matter so released. The Guest expressly assumes all risks-foreseen or unforeseen-associated with occupying the property and using its amenities, acknowledges that the released parties deny any liability, and agrees that nothing in this paragraph shall be construed as an admission of fault or liability by any released party. If any portion of this paragraph is held unenforceable, the remaining provisions shall remain in full force and effect. This paragraph shall be governed by and construed in accordance with the laws of the State of Florida.
Attorney’s Fees
In any dispute arising out of or related to this Agreement, if the Manager prevails, the Guest shall pay all reasonable attorneys’ fees and costs incurred by the Manager, including on appeal.
Waiver of Jury Trial; Mediation & Arbitration
The Parties waive the right to a jury trial. Disputes shall first be mediated; if unresolved, they shall be submitted to binding arbitration under the rules of the AmericanArbitrationAssociation in BrevardCounty, Florida, before a single arbitrator. The arbitrator’s decision is final.
Fees Schedule
Pet Fees
- $100 per dog per stay.
- Cats are not permitted; bringing a cat incurs a $500 fee.
- Undisclosed or unapproved dogs: $300 plus $100 per dog.
- Dog brought to a non‑pet‑friendly property: $750.
- Stays over 30 days: additional $200 per dog.
Smoking Fee – Smoking indoors: $500.
Plumbing Misuse Fee – Flushing foreign objects: $350.
Technology Fee – Lost, stolen, or broken smart‑lock bridge: $100 each; missing cords/charger blocks: $50 each.
Unapproved Late Checkout – $150 per hour.
Nondiscrimination
Beachside VR, LLC is committed to providing an inclusive and welcoming environment for all guests. We do not discriminate on the basis of race, color, religion, gender identity, national origin, age, disability, marital status, sexual orientation, or any other characteristic protected by law. We expect all guests to adhere to this principle of mutual respect and tolerance.
Opt‑In Marketing
By booking, the Guest consents to receive marketing communications from Beachside VR, LLC. The Guest may opt out at any time via the unsubscribe link or by emailing reservations@beachsidevr.com.

For emergencies dial 911. For assistance, contact BeachsideVR at reservations@beachsidevr.com or(321)382‑0316, preferably through the same message thread as your booking for fastest service.
Cancellation Policy
At Beachside VR, LLC, we understand that plans may change, and we strive to accommodate our guests’ needs to the best of our ability. Please note that for bookings made via Online Travel Agencies (OTAs) such as VRBO or Airbnb, their respective cancellation policies shall take precedence over the policy stated herein. For direct bookings made on our website, the following cancellation policy applies:
Full Refund: Guests are eligible for a full refund minus a 10% non-refundable deposit if they cancel their reservation within 48 hours of booking, provided that the cancellation is made at least 14 days before the scheduled check-in date.
Partial Refund: Guests who cancel their reservation between 7 and 14 days before the check-in date will receive a 50% refund of the total booking cost for all nights minus the 10% non-refundable deposit.
No Refund: Unfortunately, if a guest cancels their reservation within 7 days of the scheduled check-in date, no refund will be issued.

We highly recommend our guests to consider purchasing travel insurance to protect against unexpected circumstances that may necessitate the cancellation of their booking.
Chargebacks & Refunds
By completing a stay, the Guest accepts responsibility for all charges. Guests must attempt to resolve payment issues directly with Beachside VR before initiating a chargeback. Unjustified chargebacks may result in additional fees, legal costs, and recovery expenses; Beachside VR reserves the right to contest any chargeback and seek reimbursement.
Agreement Acknowledgment
By selecting the checkbox or providing a virtual signature at the time of booking, the Guest hereby acknowledges having read, understood, and agreed to the terms and conditions of this Agreement as set forth above. This virtual acknowledgment serves as confirmation of the Guest’s agreement to abide by the policies, rules, and expectations outlined in this Agreement for the duration of their stay at the property managed by Beachside VR, LLC.
The act of booking through our website, email confirmation, or through any Online Travel Agencies (OTAs) where our properties are listed, and providing the required virtual signature or checkbox selection, constitutes an electronic signature as defined by the Electronic Signatures in Global and National Commerce Act (E-Sign Act) and other applicable laws. This electronic signature is legally binding and holds the same validity and meaning as a handwritten signature.
